TERMS AND CONDITIONS OF ENTRY FOR THE DESIGNER BRANDS (DB) COSMETICS “20th Birthday Competition” (PROMOTION)

The Promoter is Total Beauty Network Pty Limited (ABN 45 618 507 187) of 813 Springvale Rd, Mulgrave VIC 3170(Promoter)
1. Information and instructions on how to enter and prizes form part of these terms and conditions of entry (Conditions of Entry).
2. Entry into the Promotion is deemed acceptance of these Conditions of Entry.
3. The entrant is responsible for ensuring their familiarity with the Conditions of Entry at the time of participation. The Promoter’s decision not to enforce a specific restriction (whether communicated to an entrant or not) does not constitute a waiver of that restriction or of the Conditions of Entry generally.
4. All entrants acknowledge that the Promoter can rely on these Conditions of Entry even if the Promoter only learns of a person’s ineligibility after the Promoter has awarded a prize to the ineligible person. Return of a prize or payment of its equivalent value to the Promoter may be required by the Promoter if this occurs.
5. The Promoter’s decision in relation to any aspect of these Conditions of Entry and the Promotion is final and binding on every person who enters. No correspondence will be entered into.

PROMOTION PERIOD
6. The Promotion will commence at 12.01am AEST on 1 September 2026 and conclude at 11.59pm AEST on 30 November 2026 (Promotion Period).

WHO CAN ENTER
7. Entry in the promotion is open to residents of Australia aged 18 years or over who are members of DBnation Loyalty Program and who are opted in to receive marketing communications (email and/or SMS), excluding:
a) management, employees, directors and contractors of the Promotor, Total Beauty Network its related entities and other agencies, firms or companies associated with the Promotion (including the prize suppliers);
b) a spouse, de-facto spouse, parent, guardian, child or sibling of a person referred to in paragraph 7(a) of these Conditions of Entry; and
c) persons who have breached the terms and conditions of any promotion run by or on behalf of the Promoter,
(Eligible Entrant). The persons referred to in paragraph 7(b) of these Conditions of Entry includes natural and non-natural relations (in the opinion of the Promoter) and the Promoter is responsible for determining whether a person is an Eligible Entrant in its absolute discretion.

HOW TO ENTER
8. To enter the Promotion, and receive an Eligible Entry into the draw, Eligible Entrants must, during the Promotion Period, purchase any three (3) or more Designer Brands (DB) Cosmetics products in a single transaction. The transaction may take place online at www.dbcosmetics.com.au or in-store at a participating pharmacy or retailer in Australia. After making an eligible purchase, entrants must visit www.dbcosmetics.com.au/pages/competition and provide proof of purchase to complete the entry form. Proof of purchase may include a receipt, tax invoice, order confirmation, screenshot, or other valid proof showing the eligible purchase was made during the Promotion Period. (each an Eligible Entry).
9. Eligible Entrants will receive only one (1) Eligible Entry per transaction of 3 or more DB products.
10. Entrants may enter multiple times during the Promotion Period, provided each entry relates to a separate eligible transaction and a separate entry form is submitted for each transaction.
11. Purchase alone does not constitute entry. To submit an Eligible Entry, entrants must complete and submit the entry form with valid proof of purchase and provide the details required to verify or create their DBnation membership.
12. By entering, entrants agree to become or remain a DBnation member and consent to receive DB Cosmetics marketing communications via email and/or SMS, where they are not already subscribed.
13. It is the responsibility of each entrant to ensure that their details, including their email address and mobile number, are accurate and up to date, to be eligible to enter and to be contacted if selected as a winner.
14. This Promotion is a game of chance and skill plays no part in determining the winners.
15. Illegible, late, incomplete, inaccurate, underage, erroneous, ineligible, incomprehensible or incorrect entries will be deemed invalid and therefore ineligible to enter the Promotion or win a prize. Any dispute relating to whether entries have been received or not, will be determined by the Promoter, whose decision is final. The Promoter accepts no responsibility for late, lost or misdirected entries.
16. An Eligible Entrant may submit multiple entries during the Promotion Period subject to compliance with these Conditions of Entry.
17. Any costs associated with submitting an Eligible Entry is the Eligible Entrant’s responsibility.
18. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
19. The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Entrants (including an Eligible Entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify an individual who the Promoter has reason to believe has breached any of these Conditions of Entry, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter’s discretion. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

PRIZE INFORMATION
20. The total prize pool is $20,000 AUD. This includes one $5,000 Digital Prepaid Mastercard major prize and ten $1,500 Digital Prepaid Mastercard Card prizes.
21. Prizes are subject to the relevant supplier’s conditions, including the following conditions which apply to the Digital Prepaid Mastercard: The Digital Prepaid Mastercard is issued by EML Payment Solutions Limited ABN 30 131 436 532 AFSL 404131 pursuant to license by Mastercard and distributed by the TCN Group Pty Limited ABN 87 626 501 568; T&CS apply. Redemption of the Digital Prepaid Mastercard is subject to the standard terms and conditions, which can be found at https://thecardnetwork.com.au/pages/terms conditions. Any ancillary costs associated with redeeming a Digital Prepaid Mastercard are not included. Any unused balance of a Digital Prepaid Mastercard will not be awarded as cash. Redemption of a Digital Prepaid Mastercard is subject to any terms and conditions of the issuer including those specified on the Digital Prepaid Mastercard.
22. All taxes, excluding goods and services tax (GST), which may be payable as a consequence of receiving the Prize, are the sole responsibility of the Winner.

PRIZE DRAW AND NOTIFICATION OF PRIZE WINNER
23. All valid entries will be included in the draw.
24. The draw will take place at 2pm (AEST) on 1 December 2026 at 813 Springvale Road, Mulgrave, VIC, 3170, VIC.
25. The first valid entry drawn will be the winner of the $5000 major prize, the following ten (10) valid entries drawn will each be the winners of the $1500 prizes (Winner). The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.
26. Each entrant may only win one (1) Prize during the Promotion, regardless of the number of Eligible Entries submitted. If an entrant is drawn more than once, the first Prize drawn for that entrant will be awarded and any subsequent winning entry will be disregarded, with another valid entry drawn in its place.
27. The Winners will be notified via email within seven (7) days of the draw. Winners' details (first initial, last name and postcode) will be announced on https://www.dbcosmetics.com.au/pages/competitions/pastwinners for a minimum of 28 days on and from 2 December 2026.
28. The Promoter reserves the right to request Winners to provide proof of identity, proof of residency at the nominated Prize delivery address, and proof of their Eligible Entry validity in order to claim any Prize. Proof of identification, residency and entry validity considered suitable for verification is at the discretion of the Promoter. In the event that a Winner cannot provide suitable proof, the winner will forfeit the Prize in whole, and no substitute will be offered.
29. The Promoter’s decisions are final, and no correspondence will be entered into. If a Prize is unavailable for any reason, the Promoter reserves the right to substitute another prize of equal or greater value for that Prize, or element of it, subject to the approval of any relevant authority.
30. Subject to the unclaimed prize draw clause, if for any reason a winner does not take the prize at/by the time stipulated by the Promoter, then the prize will be forfeited.
31. If a winning entry is deemed not to comply with these Conditions of Entry or any Prize remains unclaimed by 8 January 2027, the Prize will be deemed to have been forfeited and the Promoter will conduct an unclaimed prize draw, subject to any directions from a regulatory authority at 2pm (AEST) on 11 January 2027 at 813 Springvale Road, Mulgrave, VIC, 3170, VIC. Winners of the unclaimed prize draw (if any) will be notified by email within seven (7) days. Winners' details (first initial, last name and postcode) will be announced on https://www.dbcosmetics.com.au/pages/competitions/pastwinners for a minimum of 28 days on from 11 January.
32. Once the Prizes have left the Promoter’s premises, the Promoter takes no responsibility for Prizes damaged, delayed or lost in or after transit. By accepting a Prize, the Winner agrees to participate in and co-operate if required by the Promoter with all reasonable media editorial requests relating to the Promotion, including but not limited to, being interviewed and photographed and/or filmed.
33. By claiming the Prize, Winners acknowledge, consent and agree that their name and contact details will also be shared with DB Cosmetics and their sub-contractors solely for the purpose of providing access to the Prize.
34. Total prize pool value is $20,000 AUD

GENERAL
35. Dollar values are quoted in Australia dollars. Prizes are not transferable or exchangeable and cannot be redeemed for cash, unless otherwise specified.
36. All costs associated or arising in connection with a Prize are the responsibility of the respective Prize Winner.
37. The Promoter accepts no responsibility for any entries not received for any reason during the Promotion Period. No responsibility will be taken for lost, late or misdirected entries.
38. If, for any reason, the Promotion is not capable of being run as planned, including due to infection by technical difficulties, computer virus, bugs, tampering, unauthorised intervention, fraud or any other causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right in its absolute discretion to take any action that may be available to it, subject to state and/or territory regulations, including: (a) disqualifying any entrant; or (b) cancelling, terminating, modifying or suspending the Promotion.
39. The: (a) Promoter, the Promoter’s related entities and all agencies and companies associated with this Promotion; and (b) employees, agents, directors and contractors, of all entities referred to in paragraph 34(a) shall not be liable for any loss or damage (including loss of opportunity) whatsoever which is suffered (including but not limited to direct, indirect, special or consequential loss or loss of profits) or for any personal injury or death which is suffered or sustained (including without limitation to that caused by any person’s negligence) arising out of or in connection with this Promotion or the awarding or taking of the Prizes except for any liability which cannot be excluded by law (in which case liability is limited to the minimum amount allowable by law).
40. Nothing in these conditions restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable legislation including the Competition and Consumer Act, the ASIC Act or similar consumer protection laws in the States and Territories of Australia. The Promoter and its’ associated agencies and companies are not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any incorrect or inaccurate information, either caused or provided by the Eligible Entrant, any of the equipment associated with or utilized in this Promotion, any technical error, or for any combination thereof that may occur in the course of the administration of this Promotion including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries; (b) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (c) any variation in prize value to that stated in these Terms and Conditions; (d) any tax liability incurred by a winner or entrant; or (e) use of / taking of the prize, and reserves the right to take any action that may be available.

PERSONAL INFORMATION
41. The Promoter is bound by the Australian Privacy Principles in the Privacy Act 1998 (Cth) as well as any other applicable laws.

43. Entrants’ personal information (PI) will be collected to enable the Promoter and its agencies to administer and promote this Promotion and its Winners. Eligible entrants agree to DB Cosmetics using their PI for the purposes of contacting and organising the transfer of prizes to the winners. The PI of Eligible Entrants maybe provided to others assisting in the conduct of the Promotion, including suppliers and deliverers. If the PI requested is not provided, the Eligible Entrant may not participate in the Promotion. By entering this Promotion, the Eligible Entrant consents to the use of their PI as described. A request to access, update or correct any PI, should be directed to the Promoter via email (db@dbcosmetics.com.au) or phone (1300 765 332) during business hours (Monday-Friday 9.00am-5.30pm). If any Eligible Entrant does not truthfully provide all requested PI, the Promoter may determine the Eligible Entrant is not eligible to claim a Prize. Please refer to the Promoter’s Privacy Policy referred to in paragraph 37 for further information.
44. Should an Eligible Entrant’s PI change during the Promotion Period, it is the Eligible Entrant’s responsibility to notify the Promoter by using the process specified in the Promoter’s Privacy Policy.
